General terms and conditions
When you order products from us, the following general sales and delivery conditions apply.
If you order products from us on working days before 12:00, you will receive the wellness products within 1 to 4 working days.
1. General
These conditions apply to all our offers, sales, and deliveries unless otherwise agreed in writing.
The buyer is deemed to accept these conditions by the mere fact of his order.
Any purchasing conditions used by the buyer do not bind the seller if they deviate from these conditions.
2. Offers
All offers made by the seller are without obligation unless stated otherwise in writing.
Offers are never valid in combination with other discounts. The highest discount counts.
You can find offers in our newsletters and other advertising communications.
Orders and/or agreements only bind the seller after written confirmation.
Seller reserves the right to refuse orders without giving reasons.
3. Delivery times
Delivery times are always approximate. The seller undertakes to observe the specified delivery time as much as possible but is not liable for exceeding the specified delivery time.
Exceeding the delivery time does not oblige the seller to pay any compensation and does not give the buyer the right to cancel the agreement.
If the goods have not been accepted by the buyer after the delivery period has expired, they will be stored at his disposal, at his expense and risk.
4. Retention of title
Ownership of the goods to be delivered by us will not be transferred to the buyer until full payment has been made.
In the event of non-payment of a due amount, suspension of payment, application for suspension of payment, or liquidation of the buyer's affairs, we will have the right to cancel the order or the part thereof that still has to be delivered without notice of default and without judicial intervention. , to cancel and to reclaim what may have been delivered, but not paid or not fully paid, as our property, after offsetting any amount already paid, but without prejudice to our rights to demand compensation for any loss or damage. In those cases, any claim we have against the buyer is suddenly and immediately due and payable.
The goods may be resold or used by the buyer in the context of his normal business operations, but may not be given as collateral nor serve as security for a claim by a third party. As security for correct payment of all our claims, we will also acquire title as security by the occurrence of the claim on all the goods delivered by us to the buyer and which are in his possession.
5. Prices
Every quotation is without obligation unless the contrary has been agreed in writing.
If the (cost) prices increase during the period between the date of the quotation and the date of delivery, the price will be increased accordingly by the seller, taking into account any legal regulations.
6. Payment
Payment must be made net, without any discount or debt settlement, via Google Pay, Paypal, cash payment at the counter, or transfer to a bank account designated by the seller, within 30 days after the invoice date, unless otherwise agreed in writing.
The value date indicated by the bank is decisive and is therefore regarded as the payment day.
In cases that:
a. the buyer is declared bankrupt, transfers the estate, or submits a request for a suspension of payments,
b. all or part of his assets are seized,
c. the buyer dies or is placed under guardianship,
d. the buyer fails to fulfill any obligation under the law or these conditions,
e. the buyer acts in violation of any legal obligations or obligations arising from these conditions,
f. the buyer fails to pay an invoice amount or part thereof within the specified period,
g. the buyer decides to discontinue or transfer his company or a significant part thereof, or changes the objective of his company,
the mere occurrence of one of the stated circumstances, the seller has the right to either consider the purchase agreement as dissolved, without any judicial intervention being required, or to pay any amount due by the buyer on the basis of deliveries made by the seller, immediately and without any warning or notice of default is necessary, to be claimed in full, all without prejudice to the seller's right to compensation for costs, damages, and interests.
7. Interest and costs
If payment has not been made within the period stated in the previous article, the buyer is legally in default and owes statutory interest per (part of a) month on the outstanding invoice amount from the invoice date.
All judicial and extrajudicial costs incurred will be borne by the buyer. The extrajudicial collection costs will be borne by the buyer.
8. Complaints
Any complaints will only be processed by the seller if they have been reached directly in writing within 8 working days after delivery of the goods in question, accurately stating the nature and basis of the complaints.
After this period has expired, the customer is deemed to have received the delivered goods. to have approved the invoice. Complaints will then no longer be processed by the seller.
If the complaint is found to be justified by the seller, the seller is only obliged to replace the defective goods, without the buyer being entitled to any compensation whatsoever.
Submitting a complaint never releases the buyer from his payment obligations towards the seller.
Returns of the delivered goods can only take place after written permission from the seller.
9. I ordered something wrong
The ordered items can only be exchanged after consultation.
You can return a product if:
You have ordered something that is incorrect, is not older than 8 working days, is not damaged and the signet ring is not broken.
They must be returned to us at your own expense and under your responsibility.
10. I have received a damaged / defective/incorrect/incomplete product
If you have received a product that is incorrect, defective, damaged, or incomplete, you can choose to return the product free of charge within 2 weeks and replace it free of charge.
For quick and correct handling, it is important that you take a photo of the damaged product if possible and send it to vitalizaoil@gmail.com
State which company you are, contact person, your order number, and order date.
Please indicate the applicable return reason (wrong, defective, damaged, incomplete).
We kindly request that you return the product(s) in their original condition and, if possible, in the original packaging, with a (copy) of the invoice.
